Who you are dealing with

Sereno Analytics is a business run by Tiago Daubigne as a sole trader in the United Kingdom. "We" and "us" mean that business. "You" means the person or organisation with the account.

We are a one-person business and do not publish a street address. Our trading address is given on request — email hello@serenoanalytics.com and you will have it the same day.

Using the service means accepting these terms and the privacy policy.

The service

We count visits to websites you own or are authorised to work on, and show you the totals. We provide it as it is: we do not promise it will never be unavailable, and we do not offer a service level agreement. We do promise to take accuracy seriously, because a number you cannot trust is worse than no number.

The free plan

Free is free, and it is not a trial. It does not run out and there is no date on it: 10,000 page views a month, one site, and every feature the paid plans have except the API.

Going over does not close anything. The script on your site carries on recording, the numbers carry on being counted, and your dashboard carries on showing them. We will tell you that you have gone over and which plan would cover it, and that is the whole of what happens.

What it costs, and what you can expect

One number decides the price: how many page views a month you get. Starter is $10 a month or $100 a year, for 100,000 page views a month and 5 sites; Growth is $20 a month or $200 a year, for 500,000 page views a month and 25 sites. Every feature is on every plan, including the free one — nothing is held back behind a higher tier.

The price is the price. $10 means $10: there is nothing added at the last screen. Sereno holds no VAT or sales-tax registration and collects no tax on top of what you see. If that ever changes, the tax will come out of the price shown rather than be added to it — so the amount you agreed to is the amount you pay.

What it looks like on your statement. A payment appears on your card or bank statement as SERENOANALYTICS.COM. It is said here plainly because an unfamiliar line on a statement is the commonest reason somebody reports a payment they actually made. If you ever see it and are unsure, email us and it will be explained or refunded.

Who makes this. Sereno is built and maintained by one person, who is not a professional software developer. It is offered as it is. There will be bugs; report them and they will be fixed where they can be.

How long it will run. Sereno is kept running for as long as the domain is worth renewing. We are not promising it will exist for ever, and you should not build anything you cannot afford to lose on top of it. If it is ever going to close, account holders will be emailed at least 30 days beforehand with a way to take their data with them.

It may need to charge one day. If Sereno finds a real audience, running it may cost more than one person can absorb, and some part of it may have to be paid for. If that happens, account holders will be told at least 30 days before anything changes, and nobody will ever be charged without agreeing to it first. You will not be surprised by a bill.

Cancelling and refunds

Cancel whenever you like, from the billing page, in one click and without being asked why. Cancellation takes effect at the end of the period you have paid for — you keep what you have already bought.

If you are unhappy within 14 days of a payment, email us and we will refund it in full. That applies to any payment, not only your first. Beyond 14 days we do not usually refund part-used periods, but if something has gone wrong at our end, tell us and we will put it right.

If you are a consumer rather than a business, nothing here affects your statutory rights, including your right to cancel a distance contract within 14 days.

What you must not do with it

The one rule that matters, because the whole product depends on it:

• Do not use Sereno to collect personal data. Do not put names, email addresses, order numbers, account numbers or anything else that identifies a person into page paths, campaign tags or action names. If you do, you are making us process personal data we never agreed to hold, and we may close your account.

Also, and more ordinarily: do not use it for anything illegal, do not attempt to break, overload or reverse-engineer the service, and do not resell it as though it were your own product. Using it for client sites is expressly fine — that is what the site allowance on the paid plans is for.

Your data, and getting it out

The statistics collected for your sites are yours. You can look at them whenever your account is in good standing, make any of them public if you choose, and ask us for a copy. Delete your account and we delete them.

If something goes wrong

We will do our best, but we are one person and a small piece of software. To the extent the law allows, we are not liable for indirect or consequential losses — lost profits, lost business, lost data — and our total liability to you in any twelve-month period is limited to what you paid us in that period.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

Ending it

You can close your account at any time from your settings. We can suspend or close an account that breaks these terms, and we will tell you why unless the law prevents us. If we close the service altogether we will give you at least 30 days' notice, refund anything paid for time you will not get, and give you the chance to take your data with you.

Changes to these terms

We may update these terms. For anything that materially affects you we will email account holders at least 30 days beforehand. Carrying on using the service after that means accepting the new version.

Law

These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction — except that if you are a consumer elsewhere in the UK, you may bring proceedings in your own jurisdiction.
